Terms of service
These Terms govern your use of myebike.com.au and any purchase you make from us. By placing an order or using the site you agree to these Terms.
We are MyEbike Pty Ltd, ABN 62 624 432 284, trading from Shop 5/421 Brunswick St, Fortitude Valley QLD 4006. Contact: hello@myebike.com.au.
1. About these Terms
These Terms apply to retail purchases of e-bikes, accessories, parts and gift cards through this site, and to general use of the site (browsing, account creation, signing up to emails). Rent-to-Own customers are also bound by the separate Rent-to-Own Agreement signed at application; where this document and the RTO Agreement differ for rental customers, the RTO Agreement wins.
We may update these Terms from time to time. The version live on the site at the moment you place an order is the version that applies to that order.
2. Who can buy from us
To place an order you must be at least 18 and have legal capacity to enter into a contract. You must give us accurate billing, shipping and contact details. If your details are wrong and an order ships to the wrong place, that's on you.
We ship to street addresses in Australia only. See the Shipping Policy for the detail.
3. Order acceptance
A submitted order is an offer to buy, not a confirmed sale. We confirm acceptance by sending you an order-confirmation email and charging your payment method.
We may decline an order in limited cases:
- The item is out of stock and we can't restock it within a reasonable time.
- The price or product listing carries an obvious error (see clause 4).
- The order looks fraudulent.
- Delivery to your address would breach a law or carrier policy.
If we decline, we will refund any payment in full and explain why in writing.
4. Pricing accuracy and errors
All prices on the site are in Australian Dollars and include GST. Shipping is shown at checkout based on the rates in the Shipping Policy.
Prices can change between visits. The price that applies to your order is the price shown at the moment you complete checkout.
If a product is listed with an obvious pricing error (e.g. $99 instead of $1,990), we are not obliged to sell at that price. If we spot the error before dispatch we'll contact you, offer to fulfil at the correct price or refund in full, and you can choose.
Compare-at prices ("was $X, now $Y") reflect a price the product was genuinely sold at within the previous 6 weeks. We follow the Australian Competition and Consumer Commission (ACCC) guidance on two-price advertising under section 18 of the Australian Consumer Law.
5. Product specifications and descriptions
The specifications shown next to each bike and accessory — motor wattage, battery capacity, range, weight, frame size, gearing, tyre size, brake type and similar detail — are collected on a best-effort basis from each supplier's published information. Coverage and precision of that information varies between suppliers and between models, and some figures change between production runs.
Treat the data on this site as a guide, not the source of truth. For decisions where the detail really matters — sizing, replacement parts, warranty conditions, regulatory compliance — confirm the spec with the manufacturer's own documentation before relying on it. We're happy to help chase that down: email hello@myebike.com.au with the bike and the question.
This clause doesn't reduce your statutory rights under the Australian Consumer Law for goods that don't match their description in a material way. It does mean a minor spec gap or a typo isn't, on its own, grounds for return or refund.
6. Payment
We accept Visa, Mastercard, American Express, Apple Pay and Google Pay via Shopify Payments. We also accept Afterpay and Zip for eligible orders, and PayPal where listed at checkout.
When you pay through Afterpay or Zip, you enter a separate agreement with that BNPL provider. We are not a party to that agreement. Their fees, late charges and credit checks are between you and them.
Title in any product remains with us until we have received full payment. Risk in the product transfers to you on delivery (or on pickup, if you collect from the shop).
7. Stock and substitution
We hold inventory at our Fortitude Valley workshop. Inventory shown on the site is generally accurate but not real-time. If a product sells out between you ordering and us dispatching, we'll contact you within one business day with the options: wait for restock, switch to a similar bike, or refund in full.
We don't substitute a different product or colour without asking you first.
8. Delivery and returns
Delivery times, methods, signature requirements and remote-postcode handling are set out in the Shipping Policy.
Returns, refunds, change-of-mind windows, who pays return freight, restoration fees and your rights under the Australian Consumer Law are set out in the Refund and Returns Policy.
Both policies form part of these Terms.
9. Warranty and consumer guarantees
Bikes sold by MyEbike carry a 24-month manufacturer warranty on the frame, motor and battery, serviced at our Fortitude Valley workshop. Specific brand warranties may vary and are noted on the product page.
Separately and in addition, our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have a product repaired or replaced if it fails to be of acceptable quality, and the failure is not a major failure.
Nothing in these Terms limits or excludes your rights under the ACL. Where these Terms are inconsistent with the ACL, the ACL wins.
10. Accounts and security
You can place an order as a guest or create a customer account. If you create an account, you are responsible for keeping your password secret and for activity that happens under your login. Tell us straight away if you think your account has been used without your permission.
We can suspend or close an account if it's used to abuse the site, harass our staff, or attempt fraud.
11. Acceptable use of the site
When using myebike.com.au, you agree not to:
- Use the site for any unlawful purpose.
- Attempt to access, scrape, copy or interfere with parts of the site you're not authorised to use.
- Submit content (reviews, form messages, product questions) that is defamatory, harassing, misleading or infringes someone else's intellectual property.
- Use automated tools to place orders or test prices.
We reserve the right to remove content you submit if it breaches these rules.
12. Intellectual property
The site design, logo, product photography, written content and all related material are owned by MyEbike Pty Ltd or licensed to us. You can browse, share links and reproduce small extracts for personal, non-commercial use. You cannot republish, resell or commercially exploit the content without written permission.
Third-party brand names, product names and logos on the site belong to their respective owners and are used to identify products we sell.
13. Privacy
How we collect, use and store personal information is set out in the Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. The Privacy Policy is incorporated into these Terms by reference.
14. Limitation of liability
To the maximum extent permitted by law, and subject to your rights under the ACL, our total liability to you arising out of any product or order is limited to the price you paid for the product. We are not liable for indirect or consequential loss, business interruption, or loss of profit or revenue.
Nothing in this clause excludes liability that cannot be excluded by law.
15. Force majeure
We are not in breach of these Terms if performance is delayed or prevented by an event outside our reasonable control, including natural disaster, freight strike, supplier failure, pandemic, civil unrest or government restriction. We will tell you as soon as practical and either reschedule or refund.
16. Dispute resolution
If something goes wrong, talk to us first. Email hello@myebike.com.au with your order number and a short description of the issue. We will reply within one business day and try to resolve it directly.
If we can't resolve a dispute between us, either party may refer the matter to the Queensland Civil and Administrative Tribunal (QCAT) or another competent Queensland court. You can also raise consumer-law complaints with the ACCC or your state's fair-trading body, and we don't waive your right to do so.
17. Governing law
These Terms are governed by the law of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
18. Severability
If any clause of these Terms is found to be invalid or unenforceable, that clause is read down to the extent necessary to make it valid, or severed. The rest of the Terms remain in force.
19. Entire agreement
These Terms, together with the Shipping Policy, Refund Policy and Privacy Policy referenced in them (and, for rental customers, the Rent-to-Own Agreement) form the entire agreement between you and us about your use of the site and any order. They replace any prior conversation or written communication on the same subject.
